The engagement model determines how much technical and delivery management stays with the buyer.
The staff augmentation model suits buyers that already have engineering leadership. A dedicated team model gives the provider more coordination work. A managed project requires evidence that the company has delivered an outcome, not simply supplied developers.

Name the Ecuadorian or foreign entity responsible for delivery in the software outsourcing contract. The statement of work describes what that entity will deliver. Set out the treatment of IP and open-source software, repository access, security, acceptance, staffing changes, termination, and transition support.
Ecuador's Ley Orgánica de Protección de Datos Personales was published in May 2021. The Superintendencia de Protección de Datos Personales now publishes secondary rules and guidance, including provisions covering contract clauses, transfers, deletion, data-protection officers, and AI systems. This framework continued to develop during 2025 and 2026.
When the provider will access personal data, create the data map before production access. The map identifies the parties, purposes, systems, locations, subprocessors, retention periods, incident route, and international transfers. Record the arrangement in an appropriate data processing agreement. High-risk processing and cross-border transfers warrant a current Ecuadorian legal review because the applicable mechanism depends on the facts and current secondary rules.
A certificate is useful only within its stated boundary. Check whether that boundary includes the actual repository, cloud tenant, and support systems. The remaining test is a demonstration of how access is approved, reviewed, removed, and tested in the delivery environment. Which legal entity will sign and invoice? Request its full name, RUC, registered address, representative, and relationship to the delivery team.
Who will perform the work? Confirm names, roles, locations, allocation, start dates, working hours, and substitutes.
What comparable system can the proposed team demonstrate? Ask about architecture, constraints, delivery artifacts, production results, and lessons from the work.
Which responsibilities belong to each party? Clarify product decisions, architecture, planning, implementation, testing, deployment, support, and acceptance.
What does the quote include? Compare assumed hours, management, QA, infrastructure, licences, taxes, warranty, support, and change controls.
How will repositories, environments, and client data be protected? Review access approval, logging, subprocessors, incident escalation, retention, and deletion.
What happens when a team member leaves? Look for documentation, pairing, handover, replacement timing, and continuity evidence.
Can the engagement end cleanly? Confirm source ownership, credentials, documentation, data return or deletion, transition support, and final payment conditions.
Use references from work resembling the proposed engagement. Previous clients can speak to missed commitments, staff changes, difficult technical decisions, and the condition of the system at handover. Those conversations are more useful than a general testimonial.
Ecuador belongs on the shortlist when the work benefits from mainland UTC−5 collaboration and dollar-denominated contracting. The provider still has to demonstrate the required technical depth. The case is less convincing when a specialist role remains unproven, the plan assumes rapid scaling without replacement depth, or delivery ownership is unclear.
Keep the regional search open until the evidence supports a country-level decision. Buyers can apply the same process to software development in Colombia or software development in Peru.
